Bayer Corporation Files Trademark/Trade Dress Suit

    ELKHART, Ind., Jan. 18 /PRNewswire/ -- Bayer Corporation announced today
that it filed a lawsuit against Selfcare, Inc., Inverness Medical, Inc., and
Can-Am Care Corporation.  Filed in the Federal District Court for the Northern
District of Indiana, the suit charges the defendants with trademark and trade
dress infringement and unfair competition arising from Can-Am's prominent use
of Bayer's trademarks on packaging and in advertisements to promote the use of
Can-Am's Excel(R) GE test strips with Bayer's Glucometer Elite(R) blood
glucose monitors.
    Specifically, the suit claims infringement by the defendants of Bayer's
registered trademarks Glucometer Elite(R), Glucometer(R), and the Bayer(R)
Cross, and unfair competition arising out of Can-Am's use of an imitative
package design likely to confuse or mislead consumers into believing that
Can-Am's test strips originate or are associated with Bayer.  Can-Am's test
strips are not produced, licensed nor warranted by Bayer.
