MINNEAPOLIS, March 7 /PRNewswire-FirstCall/ --
A lawsuit against Health Fitness Corporation (OTC Bulletin Board: HFIT)
and two of its former employees by HealthSouth Corporation, Birmingham, Ala.,
has been dismissed in U.S. District Court in Minnesota, the Minneapolis-based
company announced today. Health Fitness Corporation (HFC) also announced that
in addition to dismissing all of HealthSouth's claims, District Court Judge
Michael J. Davis on February 13, issued an order awarding HFC a judgment of
$43,156 for its counter claim relating to certain accounts receivable.
The lawsuit, originally filed by HealthSouth Corporation in April 2000,
arose out of HealthSouth's purchase of several rehabilitation and physical
therapy clinics from HFC in May of 1999. HealthSouth claimed damages in
excess of $3.0 million, alleging misrepresentations and breaches of warranties
in the purchase agreement. In his ruling, Judge Davis granted HFC's motion to
dismiss all of HealthSouth's claims and also awarded HFC its requested
counterclaim. HealthSouth has thirty days from the entry of judgment to
appeal.
