Prudential $600M Settlement Underscores Need for E-mail Training

       Charges against Prudential Unit Bolstered by Improper E-mails

    NEW YORK, Aug. 31 /PRNewswire/ -- Once again the evidence is in the
e-mail.
    This week's $600 million settlement by Prudential Equity Group, LLC
(formerly Prudential Securities Inc) underscores the need for companies to
have proper policies in place regarding corporate e-mail. It was partially
through e-mail that employees allegedly committed violations and generated
evidence that regulators used to build their case against the Prudential
firm, a unit of which allegedly engaged in improper mutual fund trading.
    Prudential is not alone in its e-mail woes. It joins a growing list of
large and small companies (including Morgan Stanley, Merrill Lynch, CSFB,
and Merck) to suffer significant legal and public relations fallout due to
e-mail.
    Legal consultant Eric Rosenberg has written extensively on the subject
of improper e-mail use and has penned what he calls the "Seven Deadly Sins
of Business E-mail," which he uses in his presentations to companies about
the dangers of inappropriate e-mail use.
    Rosenberg has also co-developed an online training course for the very
purpose of helping companies avoid such costly mistakes as the one that
helped seal the regulators' case against Prudential. If companies would
take the time to train employees, they might even be able to protect
themselves when embarrassing or, worse, illegal, e-mails surface. The
course is one example of how companies are addressing the issue.
    This past spring, Rosenberg, in conjunction with online training

recognizing the importance of teaching employees not only etiquette, but
hard legal facts when it comes to e-mail use.
