GLENDALE, Ariz., Sept. 7 /PRNewswire/ -- The American Salvage Pool
Association (ASPA) announced today that CCC Information Services, Inc.
(Nasdaq: CCCG) (CCC) has abandoned the federal lawsuit it filed against ASPA
almost two years ago.
In December 1997, CCC filed suit in federal court seeking Declaratory
Relief from a non-compete covenant that it agreed to in 1988 with ASPA, and
for the court's opinion of monies owed ASPA for CCC's use of restricted data.
Shortly thereafter, ASPA filed a counterclaim involving breach of contract
allegations based on CCC's unauthorized use of ASPA's data, trade secret
violations, and ASPA's request for enforcement of the mutually agreed
non-compete covenant.
On August 18, 1999, at CCC's request, the federal court in Chicago
dismissed CCC's case and ASPA's counterclaim only a few weeks before the
scheduled trial date of September 13, 1999.
Now that the claims filed in federal court have been dismissed, ASPA will
re-assess all options available involving its counterclaim allegations. ASPA
President, Mark Bachman, commented that, "ASPA is encouraged by CCC's
withdrawal of its federal suit." He further stated that, "We (ASPA) are
pleased that our association's dedication to this unfortunate matter has ended
in a victorious fashion. Now that ASPA has cleared this hurdle, we will
quickly re-evaluate our position and will determine the best course of action
for the association and its members."
ASPA is a non-profit association of salvage pool operators which
represents approximately 200 members throughout the US and Canada. The
salvage pool industry primarily processes the total loss vehicle salvage
assets of insurance companies by providing a full range of management and
disposal services. ASPA is headquartered in Glendale, Ariz.
