TRUMBULL, Conn., Dec. 4 /PRNewswire-FirstCall/ -- Oxford Health Plans,
Inc. (NYSE: OHP) announced today that the plaintiffs in the provider track
cases pending in the federal multidistrict litigation (MDL) in the Southern
District of Miami against certain national managed care companies have filed a
motion for permission to file an amended complaint naming Oxford as a
defendant. The proposed amended complaint alleges, among other things, that
Oxford engaged in a RICO conspiracy with, and aided and abetted, the other
healthcare insurer defendants in improperly denying, diminishing and delaying
claim payments to a nationwide class of doctors. The complaint also seeks
treble damages, attorneys' fees and costs.
Oxford has objected to the motion for permission to file an amended
complaint as a violation of the Court's scheduling order, which gave
plaintiffs a deadline of November 13, 2002 by which to add further parties to
their complaint, and has further asserted that there is no justification for
plaintiffs' three-year delay in naming Oxford to this litigation. In the
event the Court permits plaintiffs to file the amended complaint naming Oxford
as a defendant, the Company believes it has substantial defenses to these
claims and intends to defend the action vigorously.
