COLUMBIA, Md., June 9 /PRNewswire/ -- GSE Systems, Inc.
(Nasdaq-NNM: GSES), a leading global provider of integrated enterprise
software and information solutions to the energy, process and manufacturing
industries, today announced that settlement agreements have been reached with
Yankee Atomic Electric Company (Yankee Atomic) and North Coast Software, Inc.
(North Coast) in a suit for copyright infringement and trade secret
misappropriation filed in January by a GSE subsidiary, GSE Power Systems,
Inc., against Yankee Atomic, North Coast and several other defendants
concerning simulation software known as "OpenSim."
The settlement between GSE and Yankee Atomic was mutually beneficial but
did provide, among other things, that Yankee Atomic would have no further
involvement with OpenSim. GSE dismissed its case against Yankee Atomic in
April.
GSE's settlement with North Coast provides that North Coast shall cease
selling, using, distributing, or supporting OpenSim. That settlement was set
forth in a Consent Order signed in April by the U.S. District Court for the
District of Maryland.
Jerome Feldman, Chairman of GSE Systems, issued the following statement
concerning the settlements with Yankee Atomic and North Coast: "GSE is
pleased that its OpenSim lawsuit against Yankee Atomic and North Coast was
quickly resolved by agreement, and to our mutual benefit, removing the need
for protracted and expensive litigation. GSE intends to continue its vigorous
prosecution of the case against Ryan Nuclear so as to protect GSE's rights
related to its proprietary simulation software. Ryan Nuclear sells and
distributes a version of OpenSim under the name "OpenSim NT." GSE is also
considering taking enforcement action against other parties that may have
continuing involvement in the sale, distribution or use of OpenSim, OpenSim NT
and other derivatives of GSE's proprietary software."
GSE has advised the Court that other defendants involved with OpenSim may
be added to the case against Ryan. GSE further informed the Court that new
causes of action, in addition to the pending claims of copyright infringement
and trade secret misappropriation, may be asserted against Ryan and the other
defendants based on information that has recently come to light.
The Court has established a January 1998 trial date for this matter. The
scheduling of the OpenSim case for trial early next year has led GSE to advise
the Court that it need not decide the infringement issues in connection with
GSE's motion for preliminary injunction. Now that the case has been assigned
to a new judge and the entire case has been set for trial in January, the
Company believes the infringement issues associated with OpenSim will be
decided in a reasonable time frame that also affords the opportunity to
include other parties and claims in a single proceeding. The case against the
Ryan defendants remains pending in U.S. District Court for the District of
Maryland.
