C.A.R.-Sponsored AB 2702 Passes Senate Appropriations Committee by 7 to 3 Vote; Legislation Will Increase Supply of Housing in California

    SACRAMENTO, Calif., Aug. 17 /PRNewswire/ -- California Association of
REALTORS(R)-sponsored AB 2702 (Steinberg), Ministerial Approval of Second
Units, passed the Senate Appropriations Committee today by a vote of seven to
three.  AB 2702 will increase the housing supply in California by encouraging
the development of second units, and specifies that local governments cannot
adopt ordinances that have the practical effect of barring second units from a
community.
    "AB 2702 does not strip cities of local control -- it continues to allow
local governments to prohibit second units," said C.A.R. President Ann
Pettijohn.  "AB 2702 simply prevents local governments from acting as though
they are promoting second units, when in fact their local requirements
effectively prevent the building of second units.
    "AB 2702 does not alter local zoning laws, but allows second units to be
built under those laws without forcing homeowners to have to go before a
public hearing," she said.  "Local governments will have to comply with
AB 2702 when they have second-unit ordinances that they try to make so
restrictive that they prevent second units from being built."
    Members of the state Senate Appropriations Committee voting for the
legislation included: Dede Alpert (D-San Diego), Sam Aanestad (R-Nevada City),
Roy Ashburn (R-Bakersfield), John Burton (D-San Francisco), Martha Escutia
(D-Los Angeles), Ross Johnson (R-Irvine), and Charles Poochigian (R-Fresno).
    Voting against increasing the supply of housing for families in California
were: Debra Bowen (D-Los Angeles), Betty Karnette (D-Los Angeles), and Jackie
Speier (D-San Mateo).
    Jim Battin (R-Riverside), Mike Machado (D-Stockton), and Kevin Murray
(D-Los Angeles) did not vote.
