"Software patent issues have affected some deals in the integration
middleware space. Teilhard Technologies, a Canadian company that holds
software patents in the US and Canada covering application and data
integration, has been involved in several Canadian government bids, and the
scope of its patent has caused the clients (provincial agencies in
Saskatchewan and Ontario) to insist all bidders confirm they are not in
violation of this patent. They have also presented a claim against the
Canadian data management vendor DataMirror. While this patent is as yet
legally untested, if upheld it could force all integration middleware vendors
to either modify their technologies or pay royalties. Customers who use data
integration (ETL) and application integration (EAI) technologies should ensure
that their contracts with vendors have suitable indemnity against violations
of this type of patent."

META Group Research - Analyst Insights (METAbits)
"METAGroup has reviewed Teilhard Technologies' US patent 6,195,662 B1 and
based on the information from the patent, and on our knowledge of and
experience in the IT industry we believe the claims in the patent could apply
to a variety of markets:
1. Extract, Transform, Load (ETL) - Data Warehousing
2. Application Integration (EAI)
3. Data Integration
These markets together will be several billion dollars this year,
including license and services. In addition, other markets that utilize
middleware-based data management (such as data mining, business intelligence,
and data quality management) would potentially be affected as well."
